Noticia de ESPEJO. LA FIRMA STATKRAFT AS ES LIDER EN EUROPA EN ENERGIAS RENOVABLES. El Ayuntamiento demandará a la empresa de la planta solar. Debe unos 270.000 euros correspondientes a tasas e impuestos.

El Ayuntamiento de Espejo ha anunciado que reclamará judicialmente a Statkraft AS, accionista mayoritaria de la disuelta Renewable Energies and Photovoltaics Spain SL (REPS), la deuda que mantiene con el municipio y que asciende a unos 270.000 euros en concepto de tasas e impuestos municipales.
En abril del 2011 el Consistorio concedió a REPS licencia de obra para la instalación de una planta de energía fotovoltaica denominada Parque El Salobral I, con un presupuesto de 29,7 millones de euros. Conforme a esta concesión, se realizó la correspondiente liquidación en concepto de tasas e impuestos por 300.216,48 euros. La empresa solicitó el fraccionamiento del pago de la deuda resultante de la liquidación, que fue concedido. Así, abonó el 10% de la cantidad al ser otorgada la licencia y el resto debía ser abonado más adelante. Sin embargo, tras varios meses sin tener conocimiento del comienzo de las obras de ejecución de la planta, el Ayuntamiento tuvo noticias de que REPS, participada al 70% por Statkraft AS --empresa noruega líder en Europa en energías renovables--, había entrado en disolución voluntaria a 15 de mayo del 2012.
Ante tal circunstancia, el Consistorio espejeño solicita a la Delegación Territorial en Córdoba de la Consejería de Economía, Innovación, Ciencia y Empleo un informe sobre la situación administrativa de la autorización concedida a REPS en su momento para desarrollar el proyecto. En dicho informe consta que la empresa solicitó a la Delegación la devolución del aval en agosto del 2011 alegando no haber presentado inscripción en el registro de preasignación, siendo resuelta favorablemente esta petición. Asimismo, se da por desistido al interesado por el procedimiento iniciado comunicándoselo a la empresa en octubre del 2011. Por todo ello, el Ayuntamiento ha decidido reclamar la cantidad adeudada de la liquidación y la presentación de una demanda ante los tribunales contra la empresa Statkraft AS.

Hace unos días publiqué una entrada con el título David contra Goliat.  Statkraft no puede actuar así sin perjudicar gravemente a su imagen en Europa, y hoy en día con la facilidad de las comunicaciones, hasta en todo el mundo, porque su resistencia a enfrentarse con los perjudicados tras su decisión apresurada, caprichosa e incoerente de retirar el aval hace 660 dias, abrirá una puerta a las reclamaciones judiciales, como se puede ver en este artículo de la prensa de Córdoba, hasta que indemnizen a los afectados. Entonces, cabe preguntar, si no sería más conveniente para Statkraft llegar a unos acuerdos extra judiciales, evitando los previsibles juicios y ahorrando los correspondientes gastos jurídicos.

    In April 2011 the Consistory REPS granted planning permission for the installation of a photovoltaic power plant Salobral I called Park, with a budget of 29.7 million euros. Under this grant, we performed the corresponding settlement in fees and taxes 300,216.48 euros. The company applied for installment payment of the debt resulting from the settlement, which was granted. So, paid 10% of the amount to be granted the license and the rest had to be paid later. However, after several months without knowledge of the commencement of the construction works of the plant, the City received word that REPS, owned as to 70% by Statkraft AS - Norwegian company Europe's leading renewable energy - had entered in voluntary dissolution May 15, 2012.
    In such circumstances, the Consistory espejeño Territorial Delegation requests the Cordoba of the Ministry of Economy, Innovation, Science and Job a report on the administrative status of the authorization granted to REPS in time to develop the project. In this report the company has requested the return of the collateral Delegation in August 2011 alleging failure to submit registration of earmarking, being resolved favorably this request. It also gives the interested party as withdrawn the proceedings communicating it to the company in October 2011. Therefore, the City has decided to claim the amount owed from the settlement and filing a lawsuit in court against the company Statkraft AS.

    A few days ago I posted an entry with the title David against Goliath . Statkraft can not do so would be detrimental to its image in Europe, and today with the ease of communication, even in the whole world, because their resistance to cope with the injured following his hasty decision, capricious and incoerente removing the guarantee 660 days ago, will open the door to legal claims, as seen in this article from the press of Cordova until indemnizen to those affected. So, we should ask whether it would be more convenient for Statkraft reach about extra-judicial agreements, avoiding predictable judgments and saving the corresponding legal expenses.
